[InetBib] Hadopi und das Anti-Counterfeiting Trade Agreement (ACTA)

Liebe Liste,
vielleicht darf ich Sie daraufhinweisen, dass das von Dr. Müller 
erwähnte Hadopi-Gesetz (auch Three Strikes-Modell genannt) auch Teil der 
Verhandlungen über das Anti-Counterfeiting Trade Agreement (ACTA) sind, 
über das u.a. die USA, Japan, Deutschland und die EU seit längerem 
verhandeln:

Diese Verhandlungen werden im Geheimen geführt, Unterlagen dazu haben 
nur per wikileaks den Weg in die Öffentlichkeit gefunden. Sekbst die USA 
- sonst Vorreiter in Sahcen Offenlegung der Regierungsführung - halten 
die Unterlagen "aus Gründen der nationalen Sicherheit" unter Verschluss. 
Über 100 Organisationen haben bereits Transparenz über diese 
Verhandlungen gefordert. ACTA ist als TRIPs-Nachfolgevertrag konzipiert 
- sein Hauptanliegen besteht in der strafrechtlichen Verfolgung von 
verstößen gegen die "Geistigen Eigentumsrechte".

Dort heißt es zu den befürchteten Auswirkungen.:
"Based on leaked documents and industry comments on the proposed treaty,
the groups expressed concerns that ACTA may:
+ Require Internet Service Providers to monitor all consumers' Internet
communications;
+ Interfere with fair use of copyrighted materials;
+ Criminalize peer-to-peer electronic file sharing; and
+ Undermine access to low-cost generic medicines."

Zum Schluss vielleicht noch mal Cory Doctorow dazu (vor Bibliothekaren!):
"He [C. Doctorow, K.W.] also drew our attention to ACTA – the
anti-counterfeiting trade agreement, currently being hammered out in
secret. Four key elements of ACTA are:

* The three-strike rule. This has just been passed in France, and is
under consideration in the UK. It means that anyone who is accused
(as opposed to convicted, which apparently is too expensive to
implement!) three times of copyright infringement, then your ISP
will cut off your access to the internet. All the benefits of the
internet become subject to the capriciousness of the entertainment
and publishing industries, Doctorow argued.
* Criminal sanctions for non-commercial infringements so your
children are liable to gaol time if caught trading files
* Proposals to wire tap the whole of the internet to detect
copyright infringement
* Searching at borders of hard drives including archiving of private
information."
